What are the Sick Leave Regulations in Argentina?

In Argentina, employees are entitled to sick leave with pay under the following conditions:

  • Minimum Sick Leave Duration:

    • For employees with 0 to 5 years of employment: 3 months
    • For employees with more than 5 years of employment: 6 months
  • Compensation:

    • 100%of the salary during the sick leave period, provided the employee:
      • Sends notice of illness on the first day of absence
      • Submits to medical control by a doctor appointed by the employer
  • Medical Certificate:
    • Employees must provide a medical certificate confirming their illness and the need for sick leave. This certificate is required if the sick leave extends beyond 3 consecutive days.


These requirements ensure that employees receive full pay while recovering from illness, with oversight to manage and validate the sick leave.
