What types of paid and unpaid leave are available for employees in Peru?
Peruvian labor law provides for various types of paid leave to support employees through significant life events and family needs. Understanding these entitlements helps ensure compliance and proper employee care.
Paid Leave Types
Pregnancy/Maternity Leave:
Employees are entitled to 98 calendar days of maternity leave, which includes:Prenatal leave: Up to 49 days before childbirth
Postnatal leave: Up to 49 days after childbirth
The employee must provide a Temporary Work Disability Certificate (CITT) issued by ESSALUD or a medical certificate indicating the expected delivery date.
Breastfeeding Leave:
Mothers are entitled to 1 hour per day of breastfeeding leave, typically taken during working hours.Paternity Leave:
Fathers are entitled to 10 calendar days of paid leave starting from the child's birth date.
Fathers must notify their employer at least 15 days before the expected birth date.Leave for Seriously Ill Family Member:
Employees may take up to 7 days of paid leave to care for a seriously ill family member.Bereavement Leave:
Employees receive 5 days of paid leave in the event of the death of a spouse, parent, child, or sibling.
Unpaid Leave
Peruvian labor law does not mandate paid leave for marriage or other personal events, so any such leave is typically unpaid and at the employer’s discretion.
