Can employees work during national holidays in the Philippines?
Employees in the Philippines can work during national holidays, but there are specific rules regarding holiday pay that employers must follow. According to the Department of Labor and Employment (DOLE), the regulations for holiday pay are detailed for both regular and special (non-working and working) holidays:
- For regular holidays, if an employee works, they are entitled to 200% of their daily wage for the first eight hours. For overtime work on a regular holiday, they receive an additional 30% of their hourly rate. If the day is also their rest day and they work, they receive an additional 30% on top of the 200% daily rate.
- For special non-working days, the pay rules differ slightly. If employees work on a special non-working day, they are paid an additional 30% on top of their regular salary for the first eight hours. For overtime work on a special non-working day, they receive an additional 30% of their hourly rate. If an employee does not work on a special non-working day, they are not paid unless there is a favorable company policy, practice, or collective bargaining agreement (CBA).
- Special working holidays have a different set of rules. For work performed on these days, employees are only entitled to their basic rate, without any premium pay, since work on these days is considered work on ordinary working days.
These rules apply to all covered employees, with certain groups such as managerial employees and field personnel being exempt from some of these holiday pay provisions. It's essential for employers to comply with these regulations to ensure fair compensation for employees working on holidays.
