What are the Sick Leave policies in Thailand?
In Thailand, sick leave policies are designed to support employees who are unable to work due to illness or injury. Here’s an overview of the sick leave provisions based on the Labour Protection Act:
Duration of Sick Leave
- No Maximum Duration: Sick leave can be taken for the entire duration of the illness. There is no specified maximum length for sick leave under the Labour Protection Act (Section 32), allowing employees to recover fully without time constraints.
Payment for Sick Leave
- Paid Sick Leave: Employees are entitled to paid sick leave for up to 30 days per year. This provision ensures financial support during periods of illness (Section 57 of the Labour Protection Act).
- Standard Practice: It is standard practice for employers to pay 100% of the employee’s salary during sick leave, offering full compensation while the employee is away from work.
Medical Certificate Requirements
- After 3 Days: Employees are required to provide a medical certificate if their sick leave extends beyond 3 consecutive days. This documentation verifies the illness and justifies the extended absence.
- Justification: If an employee cannot provide a medical certificate, they must provide a valid explanation for not being able to obtain one. This ensures transparency and adherence to company policies.
