What are the sick leave rules in Romania?

In Romania, employees are legally entitled to paid sick leave when they are unable to work due to illness. The Romanian Labour Code and health insurance legislation outline specific entitlements and employer obligations. 


Minimum Sick Leave Entitlement

  • Employees are entitled to a minimum of 5 paid sick leave days per year.

  • During this period, the employee receives at least 75% of their salary, though some collective agreements or employer policies may offer a higher rate.


Extended Sick Leave and Social Security Benefits

If an illness extends beyond the initial 5 days:

  • From the 6th day to the 183rd day, sick pay is provided by the National Health Fund (Casa Națională de Asigurări de Sănătate).

  • The amount covered by the Health Fund depends on the type of illness and the employee's medical insurance status, but is generally at least 75% of the calculation base.
