Unlimited (Indefinite-Term) Agreements – Standard Offering
By default, all employment contracts in Romania are considered to be for an indefinite duration, unless a fixed term can be legally justified under specific conditions.
Key features include:
Full-time and part-time options available
Social security contributions are calculated based on actual earnings
Compliant with Article 12 of the Romanian Labour Code, which governs contract duration
For part-time arrangements, the following apply:
Employees are paid based on the actual number of hours worked
Overtime is strictly prohibited for part-time workers under Article 105 of the Labour Code
Contributions to social security are based on the part-time salary received
Fixed-Term Agreements – Rarely Used
Fixed-term contracts are permitted in Romania, but only under limited legal conditions, such as for temporary projects, seasonal work, or the replacement of an absent employee. These situations are generally not applicable to standard EOR arrangements.
For this reason, Horizons rarely uses fixed-term agreements in Romania. If a fixed-term arrangement is requested, it must be reviewed on a case-by-case basis to determine whether it qualifies under the Labour Code.
