In Romania, probation periods are permitted under the Labour Code and vary depending on the type of contract and the employee's role. As an Employer of Record (EOR),
Probation Periods for Unlimited (Indefinite-Term) Contracts
For employees hired under an unlimited contract, which is the standard employment model offered by Horizons, the maximum probation period depends on the position:
Executive positions (e.g. specialists, laptop/computer-based roles): up to 90 calendar days
Management positions: up to 120 calendar days
Employees with disabilities: limited to a maximum of 30 calendar days
These probation periods allow both employer and employee to evaluate compatibility before the employment relationship continues on a long-term basis. During the probation period, termination procedures are simplified but must still follow local legal requirements.
Probation Periods for Fixed-Term Contracts
Fixed-term contracts in Romania are subject to shorter and more specific probation periods based on the length of the contract and the employee’s position:
