What are the mandatory benefits in the USA?
In the United States, certain benefits are mandated by federal law, with healthcare being a primary requirement. Employers are obligated to provide specific benefits, while others are optional and vary by company and state.
Mandatory Healthcare Plan
Healthcare Coverage:
- Affordable Care Act (ACA) Requirements: Under the Affordable Care Act (ACA), employers with 50 or more full-time equivalent employees are required to offer healthcare coverage. This requirement aims to ensure that employees have access to affordable health insurance.
- Plan Options: We provide healthcare coverage through GMS, utilizing the Cigna PPO network. Employees can choose from three tiers of coverage, depending on how much of the monthly cost the employer wishes to cover. Detailed information on the plan options and costs is available in the benefits summary booklet.

Other Mandatory Benefits
While healthcare is a key mandatory benefit, there are other benefits required by law depending on the state and employment circumstances, including:
- Social Security: Employers must contribute to Social Security, which provides retirement, disability, and survivors' benefits.
- Medicare: Employers must also contribute to Medicare, which provides health insurance for individuals aged 65 and over.
- Unemployment Insurance: Most states require employers to contribute to unemployment insurance, which provides temporary financial assistance to unemployed workers.
Optional Benefits
Apart from the mandatory benefits, many employers offer additional benefits such as paid time off (PTO), retirement plans, and wellness programs. These benefits are not legally required but are often included to attract and retain employees.
