Do work-from-home allowances exist in Germany?

As of my last update in April 2023, there is no specific legislation in Germany that mandates a general work-from-home allowance or reimbursement for expenses incurred while working from home for all employees. However, there are several points to consider regarding the costs associated with remote work:

  • Employer Agreements: Some employers voluntarily offer allowances or reimbursements for expenses related to working from home, such as internet costs, office furniture, or other necessary equipment. These are typically outlined in the employment contract or company policy.
  • Tax Deductions: Employees working from home may be eligible for tax deductions for home office expenses. For example, during certain periods, such as the COVID-19 pandemic, the German government allowed employees to deduct a specific amount per day for days worked from home, up to a maximum annual amount. The availability and specifics of such deductions can change based on current tax laws and policies.
  • Negotiations and Collective Agreements: In some cases, work-from-home allowances or compensations can be negotiated individually or are part of collective bargaining agreements within certain industries or companies.
  • Health and Safety Regulations: Employers in Germany are responsible for ensuring that work-from-home arrangements comply with health and safety regulations. This doesn't directly translate to a mandatory allowance, but it does place certain obligations on employers to consider the working conditions of home offices.
  • Legal Developments: Employment laws and regulations can evolve, and there has been increasing discussion in many countries, including Germany, about the rights of remote workers and the responsibilities of employers. It's possible that specific regulations regarding work-from-home allowances could be introduced or modified in the future.

Employees and employers are encouraged to discuss and agree upon any work-from-home arrangements, including any potential reimbursements for expenses, to ensure clarity and mutual understanding. Additionally, it's advisable to stay informed about any legal changes or new guidelines related to remote work in Germany.
