What is the standard probation period in Hong Kong?

In Hong Kong, probation periods are a common feature of employment contracts and are permitted under the Employment Ordinance (Cap. 57). Probation allows both the employer and employee to assess the suitability of the employment arrangement during the initial period of the contract.


Recommended Probation Duration

Horizons typically recommends setting a probation period of 3 to 6 months for employees hired under our Employer of Record (EOR) service in Hong Kong.

  • 3 months is the minimum practical length, often used for junior or mid-level roles.

  • 6 months may be more suitable for senior positions or roles requiring longer onboarding and evaluation.


Legal Considerations

  • A probation period must be clearly stated in the employment agreement.

  • During probation, notice periods may differ (e.g., shorter than post-probation notice) but must still meet minimum legal requirements.

  • All statutory benefits and protections under the Employment Ordinance still apply during probation, including sick leave accrual, rest days, and wage protections.
