What are the rules regarding termination of employment during incapacity for work in Cyprus?

Under the Termination of Employment Law (1967), an employer is prohibited from terminating an employee who is absent due to incapacity for work for a period of up to 12 months.

This protection begins from the first day of the employee’s absence and continues for a period that equals the total duration of the absence plus an additional one-quarter (¼) of that absence period. For example, if an employee is absent for 8 months, the prohibition on termination extends for 10 months (8 months + 2 months).

During this protected period, the employer cannot issue notice of termination based on the employee’s incapacity. Horizons strictly follows these legal protections to ensure employees’ rights are respected.
