What are the probation period rules for employment agreements in Latvia?
The duration and conditions of the probation period in Latvia depend on the type and length of the employment agreement.
1. Probation Period for Unlimited-Term (Indefinite) Employment Agreements
Maximum duration: 3 months.
Renewal or extension of the probation period is not permitted.
If the employee is temporarily incapacitated (e.g., sick leave) during probation, the probation period is suspended for that time.
2. Probation Period for Fixed-Term Employment Agreements
The probation period length depends on the duration of the fixed-term agreement:
For contracts up to 6 months: maximum probation period is 1 month.
For contracts up to 1 year: maximum probation period is 2 months.
Renewal or extension of the probation period is not permitted.
Under Latvian law, probation periods can only be renewed or extended via a collective agreement with a trade union, which does not apply to Horizons.
