How are Probation Periods regulated in France?

In France, probation periods allow employers to assess the suitability of a new employee for a role while providing the employee with a chance to evaluate the company. The length and conditions of probation periods differ based on the employee’s classification. 


Probation Periods for IC Positions (Cadre)

  • Up to 4 months, renewable once for an additional 4 months.


Probation Periods for ETAM Positions

  • Coefficient 240 - 250: Up to 2 months, renewable once for an additional 2 months.

  • Coefficient 275 - 500: Up to 3 months, renewable once for an additional 3 months.


Conditions for Extension

Extensions of the probation period should be exceptional. They require the employee’s written consent and must be documented in a formal amendment to the employment contract.


Impact of Sick Leave and Other Absences

Any sick leave or other absences during the probation period automatically suspends the probation period. This means that the duration of the probation is extended by the length of the absence.
