How is sick leave regulated in Indonesia?

In Indonesia, sick leave policies provide employees with the right to take time off work when they are ill, ensuring they have adequate time to recover without risking their employment. Here’s a detailed look at how sick leave works in Indonesia:


Sick Leave Entitlement

  • No Fixed Days: There is no statutory requirement in Indonesian labor law for a specific number of sick leave days. Instead, the duration of sick leave is based on the medical necessity as determined by a doctor.
  • Doctor’s Certificate: Employees are generally required to provide a medical certificate after one day of absence to qualify for paid sick leave. The certificate must be issued by a licensed healthcare provider and specify the duration of the required leave.


Sick Leave Payment

Indonesian law mandates a structured payment system for employees on sick leave:

  1. 0 to 4 Months of Leave:

    • Employees are entitled to receive 100% of their salary paid by the employer.
  2. 4 to 8 Months of Leave:

    • Employees are entitled to 75% of their salary paid by the employer.
  3. 8 to 12 Months of Leave:

    • Employees receive 50% of their salary during this period.
  4. 12 Months of Leave Until Termination:

    • After 12 months of continuous sick leave, employees are entitled to 25% of their salary.
    • Employers are authorized to terminate the employment contract after 12 months of continuous sick leave.


Important Notes on Sick Leave

  • Medical Certificate Requirement: A doctor’s certificate is required to validate any period of sick leave. This ensures that the leave is medically justified and allows the employer to manage absences effectively.
  • No Accrual or Carry Over: Sick leave in Indonesia does not accrue. Since there is no fixed allocation of sick leave days, employees cannot carry over unused sick leave from one year to the next.
  • Termination: Employers are allowed to terminate an employee after 12 months of continuous sick leave, following the appropriate legal procedures.
